I just wanted to let you know that I'm so sorry you have to take down the video. I mean, I kinda understand that the family of Charles Schulz would want a death-grip on his work, since it's something they want to keep sacred. (It'd be like little kids spray-painting ol' Aunt Bertha's sewing machine- To them, evil) but, they seem to have missed a MAJOR point- he did it, with an open heart, to bring smiles to other people. Big corporations don't care about Mr. S any more then they care about us.Next video- "It's all about the Benjamins baby" starring little flash guys in big suits. Anyone wanna make it?

Afetr taking a course in college and studying about copyright laws etc. I bet you could get away with that video. You are doing a Satire of the song and the cartoon. That is legal.

Unfortunately, Dan appears to be in a tough place, and it's a shame that he's placed in that situation. Fighting it as a parody would cause at least a few big problems- 1) Court costs, 2) The ire of United Media, which could seriously harm any aspirations he might have in dealing with them in the future. Current copyright law has some serious problems, and large corporations who are over-protective of IP and quick to litigation does not help matters.

I think Dan is probably most concerned about #2 on that list.

My thing is, even if we went to court and won, what do we really win? The chance to continue to show a video that we weren't making any money on in the first place, and that eats up more bandwidth than Rosie O'Donnell does snack cakes?? Why bother? We'd be spending money in the hopes of gaining nothing other than ownership/distribution in our own creative endeavor. It's better for us to accept the cease & desist, thank them for not suing us, and let sleeping dogs lie.

The real solution is to move on and ask ourselves "What's next?!?!" My mind is plenty warped & full of other ideas. Very Happy

alternatively, (though it'd be completely wrong, and illegal, and we should never do it, ) we could all place the hey ya CB video in our shared folders on our preferred file sharing program. after all, it's not Dan's fault some people had it saved to their hard drives before he removed it.

but we could never do something like that... that'd be morally wrong.

Couple of things here.

First, for AMV's go to www.animemusicvideos.org. It's a site that has probably the most extensive listing of AMV's on the planet. It's volunteer/fan run and totally free, but you'll be constantly bombarded by "Donate Please" messages since the bandwidth useage for the site must be INSANE.

Second, it was asked why AMV's don't get the c/d treatment. It's simple. Anime distributers/companies actively support AMV's. It's free advertising. God knows how many series have been sold because of AMV influences alone Rolling Eyes . The other side of the coin is the music companies. AMV creators are just too few and far between to attract their ire (and they're too buisy with p2p users to care for that matter). I have, however, heard of a couple people who got c/d orders from music companies (don't ask me who though, it's been a while and I don't remember. If you're really interested ask on the amv.org forums).

Lastly, I've been kinda lurking the Venis Board everyonce in a while since the crash, and although I had not intended to join, I see enough of intrest here to change my mind. So, "Hello, I'm new here. First post. Whoo-hoo!" Plus, starting with a new board is always nice since I don't have anything to catch up on. Wink

...Alright. Very Simple way to stop this. And Im surprised it hasn't come up before. Someone..send the video and a copy of the story to Outkast themselves. It sounds lame, and it almost sounds like a direct way to get sued...but Outkast are probably one of the more easy going groups in hip hop. I garuntee Andre3000 would have this on repeat for alittle bit..despite having created the song in the first place. I'm not sure if they'd help out that much..but im sure it couldn't hurt to have the creators of one half of the video(becuase the video just isn't as good without the song)'s opinion(Which is more than likely to be a positive).

maybe im just a hopeless dreamer...but theres a way to do this..just gotta fight it..

There are no bad guys here, no villains, no losers.

It is so rare for a creator (Charles 'Sparky' Schultz) to come up with something that people will respond to. It is even more rare when that very thing lasts the test of time, and outlives its creator. A true testament to Sparky's genius is that all of us here know of his lovable characters. Its the equivalent to having living breathing kids... and if anyone even looks at our kids funny, they wouldn't even know what hit them. I believe EVERY creator will protect our own little 'lightning in a bottle' when it really comes down to it.

That being said...
I think the 'Peanuts/Hey YA' video is brilliant!!! I loved it lots...the editing was flawless. The idea for the clip was straight up good times. (my favorite part was the end credits, where you guys said "used without permission, please don't sue us") Good grief man, totally laughed my ass off!!! The clip has been making the rounds on the internet the way 'dancing baby' did years ago. Your work is so GOOD, not all the cease and desist letters in the world will ever put a stop to it. The "people' have spoken with mouse clicks. I am surprised they didn't offer you guys a frigging' job, instead of going the scary lawyer route. IDIOTS!!!

Suzanne Vega had a good song that was recorded al cappella. Some DJ (I forget the name) added a funky beat to it on his own ... and made it GREAT! The re-mix started getting played at clubs by DJ friends sharing it with other DJ's. People loved it, and the DJ's played it. They told two friends, and they told two friends, and so on, and so forth. It took off like wildfire... when Suzanne Vega and her people got wind of it, they didn't threaten lawsuits, they recognized the genius, and went to town on it. They ALL capitalized on its success. Yup, I loves it when art manifests itself, for fun AND profit. Artists gotta eat y'all. Its a crying shame that the powers that be are asleep at the wheel here... instead of shutting down this site, they should be rewarding you in more ways than one.


My wish is that you guys take the momentum from recent events, to put your passions to the test. I'm looking forward to seeing what you guys do next -- it could very well be your very own 'lightning in the bottle' that people will still be talking about 50 or 100 years from now...

Now I feel awful that I never got to see it.... but then again, I guess things are better left that way. From everything I've heard, it sounds like you had the greatest idea going, and now they take it away from you....

But it probably is for the best, I just wish that I had seen it while it was still on the net.....

Ed, the problem is that they didn't buy his property. It was syndicated in order to appear in newspapers, as I understand that it's near impossible to get a comic published without a syndicate. (This is also why it would be really bad for Dan to be blacklisted) So they've owned the copyright, or at least the distribution rights, for a long time before he died.

Also, from what little I know of US copyright law, this wouldn't hold up as fair use, as much as we'd all like it to.

But still, it sucks that they had to get all bent out of shape about it. As if I needed another reason to hate syndicates. (Unlike Dan, I don't care about being blacklisted 'cause it'll be a cold day in hell before I do business with those cold-hearted jerks anyway)

Just as a case in point, about half of the ADV anime I've bought is due to the kinda-AMVs they make using clips and the theme song or whatever. If you haven't seen it, check out the extras menu on an ADV DVD, it'll have something like "Trailers" in there, and some of them are freakin' good. And the sole reason I picked up "Alien Nine" was because of Kat Williams's AMV. Which was worth the four hour download.
