Hey Ya, Cease and Desist!

Postby Dan » Wed Feb 04, 2004 3:29 am

I've been reprimanded by United Media for unauthorized use of copyrighted materials with that "Hey Ya"-inspired video starring that bald kid and his friends. With that, I've had to remove all materials and links to their materials from the site. That means, as well, that I'm also deleting all links from the forum, and I ask you NOT to link to any mirrors sites on this forum anymore.

Sorry kids! It's all out of my hands, now.

why don't they do that with all those anime music videos?

I bet if you get AICN on your side the big company might have to back down...but maybe its just a dog that's had its day.

United Media is a MUCH bigger company than any anime distribution company, Japanese, American, or otherwise. And, I'm pretty certain they could squash Harry Knowles and his site with their thumb.

I'm complying with their demands. We did the video as something fun and silly. We don't wan't to piss anyone off. Besides, if I ever do a newspaper comic, I don't want to automatically be blacklisted.

Parody Act

Postby Danji » Wed Feb 04, 2004 4:11 am

I would like to note, that even though I did also remove the Hey Ya Charlie Brown video from my two mirrors, that the HeyYaCB video is protected by law in the United States under the United States Content and Media Parody Act and that if you leverage that particular law, it will hold up in court all the way to the top. It has done so hundreds of times to this day, and the Supreme Court doesn't budge on that one.

However, as a showing of courtesy I did agree to remove the offending files.

(I replaced the video with something far more appealing anyway, check the links out below, hehehehehe [maniacle laughter ensues])

Hope you don't mind me using your file... though, under the circumstances, I doubt you would.

Well, my bandwidth was getting sucked up so I had to take that video down anyway.

Since I also got contacted by Ms. Gordon, I put that new .mov up in its place:

I'll work on delinking everything tomorrow. For a copy of the email I received from United Media, visit my blog www.jozjozjoz.com/

Funny, my coworkers found it without my influence. We're still watching it here, so it's still out there somewhere.

Funny also is that I put two and two together as to why AM was down for the last week and a half as soon as my coworker said to me "hey, have you seen this Charlie Brown Hey Ya thing?"

Glad to see you back up :)

Somehow I think the video won't die as easily as UM seems to think it will. People will send it to other people, who'll send it to yet more people... it's bound to happen.
